Presidency of the Assembly of States Parties expresses deep regret at the extension of US sanctions targeting the ICC President and a staff member
It is with deep concern that we note the latest actions announced by the Government of the United States against the President of the International Criminal Court and a Trial Lawyer working for the Office of the Prosecutor. These new actions, in addition to the earlier designations of the leadership of the Office of the Prosecutor and 8 judges of the International Criminal Court, are regrettable attempts to impede the Court and its personnel in the exercise of their mandated functions to investigate and adjudicate cases involving the worst crimes known to humanity.
This escalation by the US administration in the use of sanctions against the Court’s officials and staff risks undermining ongoing investigations and impeding global efforts aimed at ensuring accountability for and bringing justice to victims of the gravest crimes of concern to the international community as a whole. These sanctions erode the shared commitment to the rule of law, the fight against impunity, and the preservation of a rules-based international order.
We reiterate our full support for the Court, its officials, and all those who contribute to the fulfilment of its judicial mandate. We urge all States Parties and stakeholders in the Rome Statute system to remain steadfast in their commitment to upholding the principles of international justice and to stand united in support of the Court and the values enshrined in the Rome Statute.
The Assembly of States Parties is the management oversight and legislative body of the ICC. It is comprised of representatives of States that have ratified and acceded to the Rome Statute. Observamos con profunda preocupación las últimas medidas anunciadas por el Gobierno de los Estados Unidos contra la Presidenta de la Corte Penal Internacional y un abogado de juicio que trabaja en la Oficina del Fiscal. Estas nuevas medidas, que se suman a las anteriores designaciones de miembros de la dirección de la Oficina del Fiscal y de ocho jueces de la Corte Penal Internacional, constituyen lamentables intentos de obstaculizar a la Corte y a su personal en el desempeño de las funciones que les han sido encomendadas, consistentes en investigar y enjuiciar los casos relativos a los crímenes más graves que conoce la humanidad.
El creciente recurso de la Administración de los Estados Unidos a las sanciones contra los funcionarios y miembros del personal de la Corte corre el riesgo de socavar las investigaciones en curso y de obstaculizar los esfuerzos internacionales encaminados a garantizar que los responsables de los crímenes más graves que preocupan a la comunidad internacional en su conjunto respondan de sus actos y a hacer justicia a las víctimas. Estas medidas debilitan el compromiso compartido con el Estado de derecho, la lucha contra la impunidad y la preservación de un orden internacional basado en normas.
Reiteramos nuestro pleno apoyo a la Corte, a sus funcionarios y a todas las personas que contribuyen al cumplimiento de su mandato judicial. Instamos a todos los Estados Partes y a las partes interesadas en el sistema del Estatuto de Roma a mantenerse firmes en su compromiso con el respeto de los principios de la justicia internacional y a permanecer unidos en apoyo de la Corte y de los valores consagrados en el Estatuto de Roma.
La Asamblea de los Estados Partes es el principal órgano administrativo y legislativo de la CPI. Está compuesta por representantes de los Estados que han ratificado o se han adherido al Estatuto de Roma. La Presidencia de la Asamblea está actualmente a cargo de la Presidenta, S.E. Sra. تعرب رئاسة جمعية الدول الأطراف عن بالغ قلقها إزاء الإجراءات الأخيرة التي أعلنتها حكومة الولايات المتحدة بحق رئيسة المحكمة الجنائية الدولية وأحد محامي المحاكمة العاملين لدى مكتب المدعي العام. وتشكل هذه الإجراءات الجديدة، التي تضاف إلى إجراءات الإدراج السابقة التي طالت قيادة مكتب المدعي العام وثمانية قضاة في المحكمة الجنائية الدولية، محاولات مؤسفة ترمي إلى عرقلة المحكمة وموظفيها عن أداء المهام المنوطة بهم، والمتمثلة في التحقيق في القضايا المتعلقة بأشد الجرائم خطورة التي عرفتها البشرية والفصل فيها.
وينطوي هذا التصعيد من جانب الإدارة الأمريكية في استخدام العقوبات ضد مسؤولي المحكمة وموظفيها على خطر تقويض التحقيقات الجارية وعرقلة الجهود العالمية الرامية إلى ضمان مساءلة مرتكبي أشد الجرائم خطورة التي تهم المجتمع الدولي بأسره، وتحقيق العدالة للضحايا. كما أنه يقوّض الالتزام المشترك بسيادة القانون، ومكافحة الإفلات من العقاب، والحفاظ على نظام دولي قائم على قواعد.
ونؤكد مجدداً دعمنا الكامل للمحكمة، ولمسؤوليها، ولجميع من يسهمون في تنفيذ ولايتها القضائية. ونحث جميع الدول الأطراف وسائر الجهات المعنية في منظومة نظام روما الأساسي على التمسك بثبات بالتزامها باحترام مبادئ العدالة الدولية، وعلى الوقوف صفاً واحداً دعماً للمحكمة وللقيم المكرّسة في نظام روما الأساسي.
وتُشكِّل جمعية الدول الأطراف هيئة الإشراف الإداري والهيئة التشريعية للمحكمة الجنائيّة الدوليّة. وهي تتألف من ممثلي الدول التي قامت بالتصديق على نظام روما الأساسي أو الانضمام إليه. وتتألف رئاسة الجمعية حالياً من رئيسة الجمعية، سعادة السيدة بايفي كاوكورانتا (فنلندا)، ومن نائبي الرئيس، سعادة السيد مايكل إمران كانو (سيراليون) وسعادة السيدة مارغريتا كاسانغانا (بولندا).
