ICC concludes Framework Cooperation Arrangement with the Parliament of MERCOSUR
On 4 August 2014, Hon. Rubén Martínez Huelmo, President of PARLASUR (Parliament of the MERCOSUR, Common Market of the South) and the President of the International Criminal Court (ICC), Judge Sang-Hyun Song, met at MERCOSUR premises in Montevideo (Uruguay) to sign an Exchange of Letters for the establishment of a Framework Cooperation Arrangement between the ICC and PARLASUR. Recalling the connections between peace, justice and sustainable development, the two organisations agreed to develop their mutual cooperation on matters of common interest.
Addressing the guests of the signing ceremony convened on this occasion, President Song stated that "each and every one of the 12 MERCOSUR Member States is a State Party to the Rome Statute, and each one of them has helped pave the way for a more effective international justice system. The shared aspiration of the ICC and MERCOSUR to unite the international community through cooperation and mutual understanding is the link that allows both organizations to jointly set the stepping stones for what today is a milestone agreement, and for what tomorrow can yield new avenues of combined efforts for the greater good."
In his remarks at the signing ceremony, President of PARLASUR Rubén Martínez Huelmo indicated MERCOSUR's commitment to this institution "since the Parliament is in tune with the full force of the Rome Statute (...), which has been ratified by all the MERCOSUR Member States." He added that PARLASUR has decided to sign this arrangement for the purpose of "the promotion and dissemination of international criminal law, the promotion and dissemination of the principles, values and provisions of the Rome Statute and other related documents, and at the same time to provide public and political support for the mandate and activities of the International Criminal Court, which is implementing the Statute." Likewise, "this signature will enable the Parliament to gain prestige, as it is the only parliament of integration which has a Commission for Citizenship and Human Rights which reports annually on the status of rights and therefore is an element that participates to PARLASUR's effort in safeguarding the great values of the Rome Statute."
Speaking at the event, Uruguayan Parliamentarian Felipe Michelini said that "it is a satisfaction that we advance in our work for the universality of the Rome Statute, so that all countries of the international community accede to the Statute (...) a task, which has allowed us to move forward, and to identify common objectives in the Rome Statute for the promotion and defense of human dignity."
All countries in South America – including the 5 full members of MERCOSUR (Argentina, Brazil, Paraguay, Uruguay and Venezuela) and the 7 associate members (Bolivia, Chile, Colombia, Ecuador, Guyana, Peru and Suriname) – have joined the Rome Statute – the ICC's founding treaty. The ICC-PARLASUR Cooperation Arrangement, which is concluded in accordance with Article 87(6) of the Rome Statute, will help intensify the involvement of MERCOSUR and its Member States in the international criminal justice system. The Arrangement foresees that the ICC and PARLASUR will cooperate in matters of common interest such as: public and political support; promotion and dissemination of international criminal law, including the principles, values and provisions of the Rome Statute of the ICC; the promotion of legislation implementing the Rome Statute at national level as well as voluntary cooperation agreements of MERCOSUR Member States with the ICC; exchange of information and documents; and reciprocal invitations to conferences and meetings.

El 4 de agosto de 2014, Hon. Rubén Martínez Huelmo, presidente del PARLASUR (Parlamento del MERCOSUR, Mercado Común del Sur) y el Presidente de la Corte Penal Internacional (CPI), el juez Sang-Hyun Song, se reunieron en la sede del MERCOSUR en Montevideo (Uruguay) donde firmaron un intercambio de cartas para el establecimiento de un Acuerdo Marco de Cooperación entre la CPI y el PARLASUR. Recordando las conexiones entre la paz, la justicia y el desarrollo sostenible, las dos organizaciones convinieron en desarrollar su cooperación mutua en asuntos de interés común.
Dirigiéndose a los invitados a la ceremonia de firma celebrada en esta ocasión, el Presidente Song dijo que "todos y cada uno de los 12 Estados miembros del MERCOSUR es un Estado Parte al Estatuto de Roma, y cada uno de ellos ha ayudado a allanar el camino para un sistema de justicia internacional más eficaz. La aspiración compartida de la CPI y del MERCOSUR a unir la comunidad internacional a través de la cooperación y del entendimiento mutuo es el vínculo que permite a ambas organizaciones establecer conjuntamente los peldaños de lo que hoy es un acuerdo histórico, y de lo que mañana podrá dar nuevas vías de trabajo conjunto por el bien común."
En las palabras que pronunció en la ceremonia de firma, el presidente del PARLASUR Rubén Martínez Huelmo indicó que MERCOSUR asume un compromiso con esta institución "ya que el Parlamento está en la sintonía por la plena vigencia del Estatuto de Roma (…) y porque ha sido ratificado por todos los países integrantes del MERCOSUR". Asimismo agregó que el PARLASUR asiente firmar este acuerdo a los efectos de la "promoción y la difusión del Derecho Penal Internacional; de la promoción y la difusión de los principios, valores y disposiciones del Estatuto de Roma y otros documentos relacionados; y al mismo tiempo de dar el apoyo público y político al mandato y a las actividades de la Corte Penal Internacional, que es la que administra el estatuto". De la misma forma, "hará que el Parlamento se prestigie con esta firma, ya que es el único Parlamento de la integración que tiene una Comisión de Ciudadanía y Derechos Humanos que tiene hacer una informe anual del estado de derechos y por lo tanto es un elemento que se suma al trabajo del PARLASUR, salvaguardar los grandes valores del Estatuto de Roma."
Hablando durante el evento, el Parlamentario uruguayo Felipe Michelini dijo que "es una satisfacción que podamos sumar a nuestro trabajo por universalidad del Estatuto de Roma, para que todos los países de la comunidad internacional adhieran al Estatuto (…) tarea, que nos ha permito avanzar, e identificar en el Estatuto de Roma objetivos comunes para la promoción y defensa de la dignidad humana."
Todos los países de América del Sur - incluyendo los 5 miembros del MERCOSUR (Argentina, Brasil, Paraguay, Uruguay y Venezuela) y los 7 países asociados (Bolivia, Chile, Colombia, Ecuador, Guyana, Perú y Surinam) - se han unido al Estatuto de Roma - el tratado fundacional de la CPI. El Acuerdo Marco de Cooperación, concertado de conformidad con el párrafo 6 del artículo 87 del Estatuto de Roma, ayudará a intensificar la participación del MERCOSUR y de sus Estados miembros en el sistema de justicia penal internacional.
En el acuerdo se prevé que la CPI y el PARLASUR cooperarán en asuntos de interés común, el apoyo público y político; la promoción y la difusión del derecho penal internacional, y en particular de los principios, los valores y las disposiciones del Estatuto de Roma de la CPI; la promoción de legislación de implementación del Estatuto de Roma a nivel nacional así como de acuerdos de cooperación voluntaria de los Estados miembros del MERCOSUR con la CPI; el intercambio de información y documentos; e invitaciones recíprocas a conferencias y reuniones.
