The second resumption of the seventh session of the Assembly of States Parties to the Rome Statute of the International Criminal Court (“the Assembly”) was held from 9 to 13 February 2009 at United Nations Headquarters in New York.
 
At the second resumption, the Special Working Group on the Crime of Aggression, which has been chaired since 2003 by H.E. Mr. Christian Wenaweser, Permanent Representative of Liechtenstein to the United Nations, who is also the President of the Assembly for the period 2008-2011, concluded its discussions on, inter alia, the definition of the crime of aggression and the conditions for the exercise of jurisdiction by the Court over this crime.
 
The draft provisions on the crime of aggression under consideration include a definition of the act of aggression, which is based on United Nations General Assembly resolution 3314 (XXIX), with a threshold, an open-ended lists of acts that would qualify as an act of aggression and wording on the requisite leadership element to establish individual criminal responsibility for the act.
 
There are divergent views regarding a possible role for the United Nations Security Council prior to the initiation of an investigation by the Prosecutor. Some delegations consider the Prosecutor may only proceed with an investigation in respect of a crime of aggression if the Security Council has previously made a determination that an act of aggression has been committed by a State.
  
Other options under consideration foresee that in the absence of such a determination by the Security Council the Prosecutor may only proceed with an investigation if: 
 
  (a) The Security Council has adopted a resolution under Chapter VII of the  
       Charter requesting the Prosecutor to proceed with an investigation;
  (b) The Pre-Trial Chamber has authorized the commencement of the 
       investigation in accordance with the procedure contained in article 15;
  (c) The United Nations General Assembly has determined that an act of       
       aggression has been committed; or
  (d) The International Court of Justice has determined that an act of  
        aggression has been committed.

Furthermore, some delegations posit that the absence of a determination of an act of aggression by the Security Council should not prevent the Prosecutor from proceeding with an investigation. 
 
Additional work on the crime of aggression will be undertaken at an informal intersessional meeting tentatively scheduled for 8 to 10 June 2009 and at the eighth session of the Assembly in November in order to further refine the proposals on the crime of aggression which would be submitted for consideration by the Review Conference, scheduled to take place in Kampala, Uganda, in the first semester of 2010.
 
At the second resumption of its seventh session the Assembly also held informal consultations on the scope of the Review Conference and on the establishment of an independent oversight mechanism for the Court, foreseen in article 112, paragraph 4, of the Statute.

          عُقِدَ الاستئناف الثاني للدورة السابعة لجمعية الدول الأطراف في نظام روما الأساسي للمحكمة الجنائية الدولية ("الجمعية")، من 9 إلى 13 شباط/ فبراير 2009 في مقر الأمم المتحدة في نيويورك.

          وفي الاستئناف الثاني، اختتم الفريق العامل الخاص المعني بجريمة العدوان و الذي يرأسه منذ عام 2003 صاحب السعادة السيد كريستيان ويناويسير، سفير ليختنشتاين لدى الأمم المتحدة و هو أيضاً رئيس الجمعية للفترة 2008-2011، مناقشاته بشأن، في جملة أمور، تعريف جريمة العدوان والشروط المتعلقة بممارسة اختصاص المحكمة فيما يتعلق بهذه الجريمة.

          وتشمل مشاريع الأحكام المتعلقة بجريمة العدوان قيد البحث تعريف العمل العدواني، الذي يعتمد على قرار الجمعية العامة للأمم المتحدة 3314 (د – 29)، والذي يتضمن عتبة معينة، وقائمة مفتوحة للأعمال التي تنطبق عليها صفة العمل العدواني، وصياغة بشأن ركن القيادة اللازم لثبوت المسؤولية الجنائية للأفراد عن هذا العمل.

          ووجدت آراء مختلفة بشأن الدور الذي يمكن أن يقوم به مجلس الأمن التابع للأمم المتحدة قبل شروع المدعي العام في التحقيق في هذه الجريمة. وترى بعض الوفود أن المدعي العام لا يجوز له الشروع في التحقيق فيما يتعلق بجريمة العدوان إلا إذا خلص مجلس الأمن إلى وقوع عمل عدواني من جانب الدولة.

          وتتوقع الخيارات الأخرى قيد البحث عدم شروع المدعي العام في التحقيق في حالة عدم وجود مثل هذا القرار من مجلس الأمن إلا إذا:

(أ‌)                 اتخذ مجلس الأمن قراراً بموجب الفصل السابع من الميثاق يطلب فيه إلى المدعي العام الشروع في التحقيق؛

(ب‌)            أذنت الدائرة التمهيدية بالبدء في التحقيق وفقاً للإجراءات المنصوص عليها في المادة 15؛

(ج‌)             خلصت الجمعية العامة للأمم المتحدة إلى وقوع عمل عدواني؛ أو

(د)      خلصت محكمة العدل الدولية إلى وقوع عمل عدواني.

ومن ناحية أخرى ترى بعض الوفود أنه لا ينبغي أن يحول عدم وجود قرار من مجلس الأمن بوقوع عمل عدواني دون شروع المدعي العام في التحقيق.

إن عملاً إضافيا حول جريمة العدوان سيتعين القيام به في اجتماع غير رسمي بين الدورتين سيعقد من 8 إلى 10 حزيران/يونيه 2009 و في الدورة الثامنة للجمعية في تشرين الثاني/نوفمبر من أجل زيادة تدقيق الاقتراحات المتعلقة بجريمة العدوان و التي ستعرض للنظر على المؤتمر الاستعراضي المقرر انعقاده في كامبالا، أوغندا، في النصف الأول من عام 2010.

و في الاستئناف الثاني للدورة السابعة، عقدت الجمعية أيضاً مشاورات غير رسمية بشأن نطاق المؤتمر الاستعراضي وبشأن إنشاء آلية رقابة مستقلة للمحكمة على النحو المنصوص عليه في الفقرة 4 من المادة 112 من النظام الأساسي.

La segunda parte de la continuación del séptimo período de sesiones de la Asamblea de los Estados Partes en el Estatuto de Roma de la Corte Penal Internacional (“la Asamblea”) uvo lugar del 9 al 13 de febrero de 2009 en la sede de las Naciones Unidas en Nueva York.
 
En la segunda parte de la continuación de la sesión, el Grupo Especial de Trabajo sobre el crimen de agresión, que ha sido presidido desde 2003 por su Excelencia el Señor Christian Wenaweser, Representante Permanente de Liechtenstein antes las Naciones Unidas, quien es también Presidente de la Asamblea de los Estados Partes para el período 2008-2011, concluyó sus negociaciones sobre, entre otros asuntos, la definición del crimen de agresión y las condiciones para el ejercicio de la jurisdicción de la Corte sobre este crimen.
 
El proyecto de disposiciones sobre el crimen de agresión que se está considerando incluye una definición del acto de agresión, que está basada en la resolución 3314 (XXIX) de la Asamblea General de las Naciones Unidas, con un umbral, una lista no exhaustiva de actos que pueden ser calificados como un acto de agresión y una disposición sobre el elemento de liderazgo requerido para establecer la responsabilidad penal individual por el acto.
 
Existen opiniones contrapuestas en torno al posible papel para el Consejo de Seguridad de las Naciones Unidas con anterioridad al inicio de una investigación por parte del Fiscal.
 
Algunas delegaciones consideran que el Fiscal solamente puede dar inicio a una investigación sobre el crimen de agresión si el Consejo de Seguridad previamente ha determinado la existencia de un acto de agresión cometido por un Estado.

Otras opciones bajo consideración prevén que en ausencia de tal determinación por parte del Consejo de Seguridad, el Fiscal podría iniciar una investigación solamente si:
 
   a) El Consejo de Seguridad ha solicitado, mediante una resolución en virtud
      del capítulo VII de la Carta de las Naciones Unidas que el Fiscal inicie una
      investigación;
   b) La Sala de Cuestiones Preliminares ha autorizado el inicio de una
       investigación de conformidad con el procedimiento contenido en el
       artículo 15 del Estatuto de Roma;
   c) La Asamblea General de las Naciones Unidas ha determinado la
       existencia de un acto de agresión; o
   d) La Corte Internacional de Justicia ha determinado la existencia de un
       acto de agresión.
 
Además, algunas delegaciones consideran que la ausencia de una determinación de la existencia de un acto de agresión por parte del Consejo de Seguridad no debería impedir que el Fiscal inicie una investigación.
 
Otro tema bajo discusión es si los Estados pueden optar o no por estar sujetos a las enmiendas al Estatuto de Roma que eventualmente se adopten en relación con el crimen de agresión.
 
Negociaciones adicionales sobre el crimen de agresión tendrán lugar durante una reunión informal tentativamente prevista del 8 al 10 de junio de 2009 y durante el octavo período de sesiones de la Asamblea en noviembre con miras a refinar las propuestas sobre el crimen de agresión que luego serán sometidas a consideración de la Conferencia de Revisión, que tendría lugar en Kampala, Uganda durante el primer semestre de 2010.
 
Durante la segunda parte de la continuación del séptimo período de sesiones, la Asamblea también tuvo consultas oficiosas sobre el alcance de la Conferencia de Revisión y sobre el establecimiento de un mecanismo de supervisión independiente para la Corte, previsto en el artículo 11, párrafo 4, del Estatuto.
