Pre-Trial Chamber I declined to confirm the charges against Callixte Mbarushimana and did not commit the case to trial. The Prosecution's appeal was dismissed. On 23 December 2011, Mr Mbarushimana was released from the ICC custody.

Charges withdrawn
The confirmation of charges hearing took place from 21 September to 5 October 2011. Charges withdrawn due to insufficient evidence. Case also involved charges against Francis Kirimi Muthaura and Mohammed Hussein Ali. Judges declined to confirm charges against Mohammed Hussein Ali on 23 January 2012.

Found guilty, on 7 March 2014, as an accessory to one count of a crime against humanity (murder) and four counts of war crimes (murder, attacking a civilian population, destruction of property and pillaging) committed on 24 February 2003 during the attack on the village of Bogoro, in the Ituri district of the DRC. The judgment is final, as both the Defence and Prosecution withdrew their appeals on 25 June 2014. Sentenced to a total of 12 years' imprisonment; time spent in detention at the ICC – between 18 September 2007 and 23 May 2014 – was deducted from the sentence.

The Blé Goudé case and Gbagbo case were joined on 11 March 2015. The trial began on 28 January 2016. On 15 January 2019, Trial Chamber I, by majority, acquitted Mr Laurent Gbagbo and Mr Charles Blé Goudé from all charges of crimes against humanity allegedly committed in Côte d'Ivoire in 2010 and 2011. On 1 February 2019, the Appeals Chamber set conditions to be imposed on Mr Gbagbo and Mr Blé Goudé upon their release to a State willing to accept them on its territory and willing and able to enforce the conditions set by the Chamber. On 16 July 2019, Trial Chamber I filed the written full reasons for the acquittal of Mr Laurent Gbagbo and Mr Charles Blé Goudé. On 16 September 2019, the Prosecutor filed a notice of appeal against this decision.
On 31 March 2021, the Appeals Chamber confirmed, by majority, the acquittal decision of 15 January 2019.
Next steps: The acquittal of Mr Gbagbo and Mr Blé Goudé is now final. The Appeals Chamber revoked all conditions on the release of Mr Gbagbo and Mr Blé Goudé. The Chamber directed the ICC Registrar to make arrangements for the safe transfer of Mr Gbagbo and Mr Blé Goudé to a receiving State or States.

The warrant of arrest for Saif Al-Islam Gaddafi was issued on 27 June 2011. He is not in the Court's custody. Case also involved charges Muammar Gaddafi and Abdullah Al-Senussi in warrant issued on 27 June 2011. Case against Abdullah Al-Senussi was declared inadmissible on 11 October 2013. Case against Muammar Gaddafi was terminated on 22 November 2011, following his death.

The warrants of arrest in this case were issued under seal on 8 July 2005 and unsealed on 13 October 2005. The suspect Joseph Kony is still at large. While the case originally involved Raska Lukwiya, Okot Odhiambo and Vincent Otti, proceedings against them were terminated due to their passing.
On 23 November 2023, Pre-Trial Chamber II issued a preliminary decision on the Prosecutor’s Request to hold a confirmation of charges hearing in Mr Kony’s absence. The Prosecutor filed the Document Containing the Charges on 19 January 2024. On 4 March 2024, Pre-Trial Chamber II issued a decision on the Prosecutor’s request to hold a confirmation of charges hearing in the case against Joseph Kony in the suspect’s absence, should he not appear, and set the date for this hearing, to commence on 15 October 2024.
On 12 September 2024, Pre-Trial Chamber postponed the commencement of the confirmation hearing scheduled for 15 October 2024, following the Defence, Prosecution, and Office of the Public Counsel for Victims observations. On 29 October 2024, Pre-Trial Chamber III issued a decision concluding that all the requirements to hold a confirmation of charges hearing in the absence of the suspect Joseph Kony are now met.
On 17 April 2025, the Office of the Prosecutor submitted an Amended Document Containing the Charges. According to it, Joseph Kony is suspected of 39 counts of war crimes and crimes against humanity, allegedly committed between at least 1 July 2002 until 31 December 2005 in northern Uganda.
The confirmation of charges hearing in the Kony case took place on 9 and 10 September 2025 at the seat of the Court in The Hague. The hearing was held in the absence of the suspect, who was represented by Defence Counsel Peter Haynes, KC. On 6 November 2025, Pre-Trial Chamber III confirmed all the 39 charges brought by the Prosecutor in the Kony case and committed Mr Kony to trial before a Trial Chamber.
Next steps: Although the charges are confirmed, this trial would require Mr Kony to be present before the ICC as trials cannot be held in the suspect’s absence, according to the ICC Rome Statute, the Court’s founding treaty.
