Statement of ICC President Judge Tomoko Akane on the Day of International Criminal Justice
Twenty-eight years ago today, the Rome Statute was born from a shared conviction: that the most serious crimes of concern to the international community as a whole must not go unpunished. Its adoption made possible the creation of the International Criminal Court, which is the only permanent international criminal court established to end impunity for the perpetrators of those crimes.
Since then, the International Criminal Court has been fulfilling its mandate and is now seized of situations from regions across the world. The Court has never been busier, reflecting the continued relevance of its mission.
On this International Criminal Justice Day, let us recall that the international rule of law cannot exist without independent judicial institutions that uphold the law through the decisions of impartial judges. The International Criminal Court is one such institution. By exercising its jurisdiction over individuals accused of committing the most serious crimes of concern to the international community, the Court provides a necessary mechanism for accountability and offers hope to victims of these grave crimes.
International courts must always remain independent and free from political influence and coercion. This guarantees their impartiality and ensures fair proceedings. Yet in recent years, international law has come under increasing pressure, through both direct attacks and a weakening of the commitment to uphold it. It has never been more important than it is today to defend the international rule of law and to continue the pursuit of justice. Even in the most challenging times, the International Criminal Court will remain steadfast in its mission: to bring justice to the victims of the most serious crimes of concern to the international community.
Thanks to the continued support of States Parties and civil society, and the commitment of its staff, the Court is able to continue delivering on its demanding but indispensable mandate. On this International Criminal Justice Day, let us remember that the pursuit of justice is a shared responsibility. Above all, let us remember those who are still waiting for justice for the crimes committed against them.

Un día como hoy hace veintiocho años, el Estatuto de Roma vio la luz, fruto de una convicción compartida: que los crímenes más graves de trascendencia para la comunidad internacional en su conjunto no deben quedar sin castigo. Su adopción hizo posible la creación de la Corte Penal Internacional, que es el único tribunal penal internacional permanente establecido para poner fin a la impunidad de los autores de esos crímenes.
Desde entonces, la Corte Penal Internacional ha venido cumpliendo su mandato y actualmente se ocupa de situaciones en diversas regiones del mundo. La Corte nunca había estado tan ocupada, lo que refleja la continua relevancia de su misión.
En este Día de la Justicia Penal Internacional, recordemos que el Estado de Derecho internacional no puede existir sin instituciones judiciales independientes que defiendan la ley a través de las resoluciones de jueces imparciales. La Corte Penal Internacional es una de esas instituciones. Al ejercer su jurisdicción sobre las personas acusadas de cometer los crímenes más graves de trascendencia para la comunidad internacional, la Corte proporciona un mecanismo necesario para la rendición de cuentas y ofrece esperanza a las víctimas de estos graves crímenes.
Los tribunales internacionales deben mantener siempre su independencia y estar libres de influencias políticas y coacciones. Esto garantiza su imparcialidad y asegura procedimientos justos. Sin embargo, en los últimos años, el derecho internacional se ha visto sometido a una presión cada vez mayor, tanto a través de ataques directos como de un debilitamiento del compromiso de defenderlo. Nunca ha sido tan importante como hoy defender el Estado de derecho internacional y seguir en la búsqueda de la justicia. Incluso en los momentos más difíciles, la Corte Penal Internacional se mantendrá firme en su misión: hacer justicia para las víctimas de los crímenes más graves de trascendencia para la comunidad internacional.
Gracias al apoyo constante de los Estados Partes y de la sociedad civil, así como al compromiso de su personal, la Corte puede seguir cumpliendo su exigente pero indispensable mandato. En este Día de la Justicia Penal Internacional, recordemos que la búsqueda de la justicia es una responsabilidad compartida. Y, sobre todo, recordemos a quienes siguen esperando que se haga justicia por los crímenes cometidos contra ellos.

قبل ثمانية وعشرين عاماً، وُلد نظام روما الأساسي انطلاقاً من قناعة مشتركة مفادها أن أشد الجرائم خطورة، التي تهم المجتمع الدولي بأسره، يجب ألا تمر من دون عقاب. وقد أتاح اعتماد النظام الأساسي إنشاء المحكمة الجنائية الدولية، وهي المحكمة الجنائية الدولية الدائمة الوحيدة المنشأة لوضع حد لإفلات مرتكبي هذه الجرائم من العقاب.
ومنذ ذلك الحين، تضطلع المحكمة الجنائية الدولية بولايتها، وهي تنظر اليوم في حالات ناشئة عن مناطق مختلفة من العالم. ولم يسبق أن كان الطلب على عمل المحكمة بهذا الحجم، الأمر الذي يؤكد استمرار أهمية رسالتها ووجاهتها.
وفي يوم العدالة الجنائية الدولية هذا، لنتذكر أن سيادة القانون على الصعيد الدولي لا يمكن أن تقوم من دون مؤسسات قضائية مستقلة تطبق القانون من خلال قرارات يصدرها قضاة محايدون. والمحكمة الجنائية الدولية هي إحدى هذه المؤسسات. فمن خلال ممارستها اختصاصها على الأشخاص المتهمين بارتكاب أشد الجرائم خطورة التي تهم المجتمع الدولي بأسره، تشكل المحكمة آلية أساسية لمكافحة الإفلات من العقاب، وتمنح ضحايا هذه الجرائم الخطيرة أملاً في تحقيق العدالة.
ويجب أن تظل المحاكم الدولية مستقلة ومصونة من أي تأثير سياسي أو أي شكل من أشكال الإكراه. فهذا هو ما يكفل حيادها ويضمن عدالة الإجراءات أمامها. غير أن القانون الدولي تعرض، خلال السنوات الأخيرة، لضغوط متزايدة، سواء من خلال الهجمات المباشرة عليه أو من خلال تراجع الالتزام باحترامه. ولم يكن الدفاع عن سيادة القانون على الصعيد الدولي ومواصلة السعي إلى تحقيق العدالة أكثر أهمية مما هو عليه اليوم. وحتى في أشد الظروف صعوبة، ستظل المحكمة الجنائية الدولية متمسكة بثبات بمهمتها المتمثلة في إحقاق العدالة لضحايا أشد الجرائم خطورة التي تهم المجتمع الدولي بأسره.
وبفضل الدعم المتواصل الذي تقدمه الدول الأطراف والمجتمع المدني، فضلاً عن تفاني موظفي المحكمة، تستطيع المحكمة مواصلة الاضطلاع بولايتها، على الرغم مما تنطوي عليه من متطلبات جسيمة، وما تتسم به في الوقت ذاته من ضرورة لا غنى عنها. وفي يوم العدالة الجنائية الدولية هذا، لنتذكر أن السعي إلى تحقيق العدالة مسؤولية مشتركة. والأهم من ذلك، ألا ننسى النساء والرجال الذين ما زالوا ينتظرون إحقاق العدالة بشأن الجرائم التي وقعوا ضحايا لها.
