Statement by the ASP Presidency concerning the receipt of the OIOS fact-finding report on alleged misconduct by the ICC Prosecutor
The Presidency of the Assembly of States Parties informs that the fact-finding investigative report by the Office of the Internal Oversight Services (OIOS) on alleged misconduct by the ICC Prosecutor has been received by the President of the Assembly of States Parties on 11 December 2025 and has been forwarded immediately to the Panel of judicial experts established by the Bureau of the Assembly. The submission of the investigative report to the panel follows the procedure previously established by the Bureau and in no way provides any indication as to the findings of the report.
The Panel will conduct an assessment under the legal framework of the Rome Statute, the Rules of Procedure and Evidence of the Court and relevant administrative instruments, in assistance of the Bureau’s consideration of the matter. The Panel will report to the Bureau via the President of the Assembly upon completion of its work, which is anticipated to take thirty calendar days, subject to the complexity of the issues. Once completed, the work of the judicial experts together with the OIOS report will be considered by the Bureau in accordance with the Rome Statute and the legal framework of the Court.
The Presidency of the Assembly continues to call for due respect for the privacy and the rights of all parties concerned, as well as for the integrity of the ongoing process.
The Assembly of States Parties is the management oversight and legislative body of the ICC. The Bureau of the Assembly consists of a President, two Vice-Presidents and 18 members elected by the Assembly for three-year terms. The Presidency of the Assembly is currently composed of Ambassador Ms. Päivi Kaukoranta (Finland), President, Ambassador Mr. Michael Imran Kanu (Sierra Leone), Vice-President, and Ambassador Ms. Margareta Kassangana (Poland), Vice-President.
La Presidencia de la Asamblea de los Estados Partes informa de que el informe de investigación de la Oficina de Servicios de Supervisión Interna (OSSI) sobre la presunta conducta indebida del Fiscal de la Corte Penal Internacional ha sido recibido por la Presidenta de la Asamblea de los Estados Partes el [fecha] y ha sido remitido de inmediato al Grupo de expertos judiciales establecido por la Mesa de la Asamblea. La presentación del informe de investigación al Grupo de expertos sigue el procedimiento previamente establecido por la Mesa y en ningún caso ofrece indicación alguna sobre las conclusiones del informe.
El Grupo llevará a cabo una evaluación con arreglo al marco jurídico del Estatuto de Roma, las Reglas de Procedimiento y Prueba de la Corte y los instrumentos administrativos pertinentes, como apoyo al examen del asunto por parte la Mesa. El Grupo informará a la Mesa a través de la Presidenta de la Asamblea al término de su trabajo, que se prevé que dure treinta días naturales, en función de la complejidad de las cuestiones. Una vez completado, el trabajo de los expertos judiciales junto con el informe de la OSSI será examinado por la Mesa de conformidad con el Estatuto de Roma y el marco jurídico de la Corte.
La Presidencia de la Asamblea sigue pidiendo el debido respeto a la intimidad y los derechos de todas las partes implicadas, así como a la integridad del proceso en curso.

تُعلن رئاسة جمعية الدول الأطراف أن رئيس جمعية الدول الأطراف قد استلم تقرير التحقيق لتقصي الحقائق الصادر عن مكتب خدمات الرقابة الداخلية بشأن سوء السلوك المزعوم من جانب المدعي العام للمحكمة الجنائية الدولية بتاريخ في 11 ديسمبر/ كانون أول 2025، وقد تم إرسالها فوراً إلى لجنة الخبراء القضائيين التي شكلها مكتب الجمعية. ويأتي تقديم التقرير التحقيقي إلى اللجنة وفقاً للإجراءات التي سبق أن وضعها المكتب، ولا يُعدّ بأي حال من الأحوال مؤشراً على نتائج التقرير.
ستتولى لجنة الخبراء إجراء تقييم في إطار النظام الأساسي لروما وقواعد الإجراءات والأدلة الخاصة بالمحكمة والأدوات الإدارية ذات الصلة، وذلك لمساعدة المكتب في النظر في المسألة. ستقدم لجنة الخبراء تقريرها إلى المكتب عبر رئيس الجمعية عند الانتهاء من عملها، والذي من المتوقع أن يستغرق ثلاثين يومًا تقويميًا، وذلك رهناً بمدى تعقيد القضايا. وبمجرد الانتهاء، سيتولى المكتب النظر في عمل لجنة الخبراء القضائيين مع تقرير مكتب خدمات الرقابة الداخلية وفقًا لنظام روما الأساسي والإطار القانوني للمحكمة.
وتواصل رئاسة الجمعية الدعوة إلى الاحترام الواجب لخصوصية وحقوق جميع الأطراف المعنية، فضلاً عن سلامة العملية الجارية.
تُعدّ جمعية الدول الأطراف الهيئة الإدارية والتشريعية للمحكمة الجنائية الدولية. ويتألف مكتب الجمعية من رئيس ونائبين للرئيس و18 عضواً تنتخبهم الجمعية لمدة ثلاث سنوات. وتتألف رئاسة الجمعية حالياً من السفيرة بايفي كاوكورنتا (فنلندا) رئيسةً والسفير مايكل عمران كانو (سيراليون) نائباً للرئيس والسفيرة مارغريتا كاسانغانا (بولندا) نائبةً للرئيس.
