Statement by the ASP Presidency concerning the receipt of the external judicial expert Panel report on alleged misconduct by the ICC Prosecutor
The Presidency of the Assembly of States Parties to the Rome Statute confirms that the conclusions of the Panel of judicial experts on alleged misconduct by the ICC Prosecutor were received on 9 March 2026, by the President of the Assembly of States Parties.
The Panel, established by a decision of the Bureau of the Assembly of States Parties, was mandated to conduct its assessment under the legal framework of the Rome Statute, the Rules of Procedure and Evidence of the Court and relevant administrative instruments. The Panel was further mandated, in assistance of the Bureau, to legally characterize the factual findings, as established in the report of the United Nations Office of Internal Oversight Services (OIOS).
The Bureau will convene within 5 working days to start considering the reports of the OIOS and the Panel. These reports are confidential and will not be made publicly available.
The Presidency of the Assembly continues to call for due respect for the privacy and the rights of all parties concerned, as well as for the integrity of the ongoing process.
The Assembly of States Parties is the management oversight and legislative body of the ICC. It is comprised of representatives of States that have ratified and acceded to the Rome Statute.

La Presidencia de la Asamblea de los Estados Partes en el Estatuto de Roma confirma que el 9 de marzo de 2026 recibió las conclusiones del grupo externo de expertos judiciales relativo a la presunta conducta indebida del Fiscal de la Corte Penal Internacional.
El grupo de expertos, establecido en virtud de la decisión de la Mesa de la Asamblea de los Estados Partes, recibió el mandato de llevar a cabo su evaluación en el marco jurídico del Estatuto de Roma, las Reglas de Procedimiento y Prueba de la Corte y los instrumentos administrativos pertinentes. Asimismo, se encomendó al grupo de expertos, en asistencia de la Mesa, calificar legalmente los constataciones factuales, conforme a lo establecido en el informe de la Oficina de Servicios de Supervisión Interna (OSSI) de las Naciones Unidas.
La Mesa se reunirá en un plazo de cinco días laborables para comenzar a examinar los informes de la OSSI y del grupo de expertos. Dichos informes son confidenciales y no se pondrán a disposición del público.
La Presidencia de la Asamblea insiste en la necesidad de que se respeten debidamente la privacidad y los derechos de todas las partes interesadas, así como la integridad del proceso en curso.
La Asamblea de los Estados Partes es el órgano de supervisión de la gestión y legislativo de la Corte. Está compuesta por representantes de los Estados que han ratificado el Estatuto de Roma o se han adherido a él.
