Presidency of the Assembly of States Parties expresses deep concern and rejects U.S. measures targeting ICC officials as a threat to international justice
It is with deep concern that we note the latest actions announced by the Government of the United States against [4] elected officials of the International Criminal Court. These new actions, in addition to an earlier designation of an elected official, are regrettable attempts to impede the Court and its personnel in the exercise of their independent judicial functions.
We firmly and unequivocally reject these unilateral measures. They represent a regrettable affront to the independence of the Court and the integrity of the Rome Statute system. Such actions risk undermining global efforts to ensure accountability for the gravest crimes of concern to the international community and erode the shared commitment to the rule of law, the fight against impunity, and the preservation of a rules-based international order.
The International Criminal Court is a cornerstone of international justice. It functions as an independent and impartial judicial body, operating in full accordance with its founding treaty, the Rome Statute.
We reiterate our full support for the Court, its officials, and all those who contribute to the fulfilment of its judicial mandate. We urge all States Parties and stakeholders in the Rome Statute system to remain steadfast in their commitment to uphold the principles of international justice and to stand united in defending the Court and protecting the values enshrined in the Rome Statute, undaunted by any external pressure or coercive measure directed against the institution or its personnel.
The Assembly of States Parties is the management oversight and legislative body of the ICC. It is comprised of representatives of States that have ratified and acceded to the Rome Statute. The Presidency of the Assembly is currently composed of President Päivi Kaukoranta (Finland) and Vice-Presidents Michael Imran Kanu (Sierra Leone) and Margareta Kassangana (Poland).

إنّ رئاسة جمعية الدول الأطراف، وإذ تُعرب عن بالغ قلقها، تُسجّل الإجراءات الأخيرة التي أعلنت عنها حكومة الولايات المتحدة الأمريكية بحقّ أربعة من المسؤولين المنتخبين في المحكمة الجنائيّة الدوليّة. وتُعدّ هذه التدابير الجديدة، إلى جانب الإجراء السابق الذي استهدف أحد المسؤولين المنتخبين، محاولات مؤسفة تُعيق عمل المحكمة وتَحول دون اضطلاع موظفيها بمهامهم القضائيّة المستقلة.
وإنّنا نرفض رفضًا قاطعًا وبصورة لا لبس فيها هذه الإجراءات الأُحادية الجانب. فهي تُعدّ مساسًا مؤسفًا باستقلالية المحكمة وبنزاهة نظام روما الأساسي. كما أنّ من شأن هذه التدابير تقويض الجهود العالميّة الرامية إلى ضمان المساءلة عن أخطر الجرائم التي تُثير قلق المجتمع الدولي، وإضعاف الالتزام المشترك بسيادة القانون ومكافحة الإفلات من العقاب والحفاظ على النظام الدولي القائم على القواعد الثابتة.
وتُمثّل المحكمة الجنائيّة الدوليّة حجر الأساس في سياق العدالة الدولية، وهي تضطلع بمهامها كهيئة قضائيّة مُستقلة ومُحايدة، إذ أنّها تعمل بما يتّفق تماماً مع معاهدتها التأسيسية، أي نظام روما الأساسي.
وإنّنا نؤكد مُجددًا دعمنا الكامل للمحكمة ومسؤوليها وجميع من يسهمون في تنفيذ وإنجاز ولايتها القضائيّة.
وندعو جميع الدول الأطراف وجميع المعنيين في إطار نظام روما الأساسي إلى الثبات في التزامهم الراسخ بمبادئ العدالة الدولية، والوقوف صفًا واحدًا دفاعًا عن المحكمة وصونًا للقيم المنصوص عليها في نظام روما الأساسي، دون أن يُثنيهم عن ذلك أي ضغط خارجي أو أي تدبير قسري يستهدف المؤسسة أو أفرادها.
وتُشكِّل جمعية الدول الأطراف هيئة الإشراف الإداري والهيئة التشريعية للمحكمة الجنائيّة الدوليّة. وهي تتألف من ممثلي الدول التي قامت بالتصديق على نظام روما الأساسي أو الانضمام إليه. وتتألف رئاسة الجمعية حالياً من رئيسة الجمعية، سعادة السيدة بايفي كاوكورانتا (فنلندا)، ومن نائبي الرئيس، سعادة السيد مايكل إمران كانو (سيراليون) وسعادة السيدة مارغريتا كاسانغانا (بولندا).
