Allegedly responsible for ordering, inducing or soliciting the crime against humanity of persecution on gender grounds against girls, women and other persons non-conforming with the Taliban’s policy on gender, gender identity or expression; and on political grounds against persons perceived as “allies of girls and women” (under article 7(1)(h) of the Rome Statute). The crimes were allegedly committed in connection with conducts of murder, imprisonment, torture, rape and enforced disappearance, on the territory of Afghanistan since the Taliban seized power on 15 August 2021, and have continued until at least 20 January 2025.

Charges: 20 counts of crimes against humanity: murder, persecution, forcible transfer of population, rape, inhumane acts, imprisonment or severe deprivation of, and torture; and 22 counts of war crimes: murder, attacks against the civilian population, destruction of property, rape, pillaging, and outrage upon personal dignity, allegedly committed at least between 2003 and 2004 in Darfur, Sudan.

Charges: 7 counts of crimes against humanity: persecution, murder, forcible transfer, rape, inhumane acts, imprisonment or severe deprivation of liberty, and torture; and 6 counts of war crimes: murder, attacks against a civilian population, destruction of property, rape, pillaging, and outrage upon personal dignity, allegedly committed at least between 2003 and 2004 in Darfur, Sudan

Allegedly responsible for the war crime of directing attacks at civilian objects (article 8(2)(b)(ii) of the Rome Statute) and the war crime of causing excessive incidental harm to civilians or damage to civilian objects (article 8(2)(b)(iv) of the Rome Statute), and the crime against humanity of inhumane acts under article 7(1)(k) of the Rome Statute. There are reasonable grounds to believe that Mr Kobylash bears individual criminal responsibility for the aforementioned crimes for (i) having committed the acts jointly and/or through others (article 25(3)(a) of the Rome Statute), (ii) ordering the commission of the crimes, and/or (iii) for their failure to exercise proper control over the forces under their command (article 28(a) of the Rome Statute).

Charges: Found guilty, as an accessory, of one count of crime against humanity: murder; and four counts of war crimes: murder, attacking a civilian population, destruction of property and pillaging, committed on 24 February 2003 during the attack on the village of Bogoro, in the Ituri district of the DRC. Case also involved charges against Mathieu Ngudjolo Chui but the 2 cases were severed on 21 November 2012. Mathieu Ngudjolo Chui was acquitted on 18 December 2012.

Charges: five counts of crimes against humanity allegedly committed during the 2007-2008 post-election violence in Kenya. Prosecutor withdrew charges. Case also involved charges against Francis Kirimi Muthaura and Mohammed Hussein Ali. Judges declined to confirm charges against Mohammed Hussein Ali on 23 January 2012

Charges: 4 crimes against humanity: imprisonment, torture, persecution, and other inhumane acts allegedly committed in Libya from 15 February 2011 until 24 August 2011; and 3 war crimes: torture, cruel treatment and outrages upon personal dignity allegedly committed in Libya from at least early March 2011 to 24 August 2011.

Charges:  Joseph Kony is accused of 39 counts of war crimes and crimes against humanity, allegedly committed between at least 1 July 2002 until 31 December 2005 in northern Uganda. The accused is still at large. While case originally involved Raska Lukwiya, Okot Odhiambo and Vincent Otti, proceedings against them were terminated due to their passing. 

Charges: four crimes against humanity allegedly committed during the 2007-2008 post-election violence in Kenya. On 23 January 2012, the Judges declined to confirm the charges against Mr Kosgey. His case also involved William Samoei Ruto and Joshua Arap Sang. The Ruto and Sang case was terminated on 5 April 2016.
