On 8 February 2010, Pre-Trial Chamber I decided not to confirm the charges against Mr Abu Garda, and later rejected the Prosecutor's application to appeal the decision.

Case also involved Saleh Mohammed Jerbo Jamus but proceedings against him were terminated on 4 October 2013 following his passing.

On 7 March 2011, Pre-Trial Chamber I unanimously confirmed the charges of war crimes brought by the ICC Prosecutor against Abdallah Banda and committed him to trial. Although Mr Banda appeared voluntarily before the ICC during the pre-trial stage of the proceedings, Trial Chamber IV issued an arrest warrant on 11 September 2014 to ensure his presence at trial. 

On 23 July 2026, following the withdrawal of the charges by the Prosecution, Trial Chamber IV terminated the proceedings against Mr Banda and vacated the arrest warrant against him. 

Next steps: The case is considered closed following the termination of the proceedings. The arrest warrant against Mr Banda has been vacated.

The confirmation of charges hearing took place from 21 September to 5 October 2011. Charges withdrawn due to insufficient evidence. Case also involved charges against Francis Kirimi Muthaura and Mohammed Hussein Ali. Judges declined to confirm charges against Mohammed Hussein Ali on 23 January 2012.

Charges vacated

On 5 April 2016, Trial Chamber V(A) decided, by majority that the case against William Samoei Ruto and Joshua Arap Sang is to be terminated. The parties have not appealed this decision. Case also involved Henry Kiprono Kosgey. Judges declined to confirm the charges against Mr Kosgey on 23 January 2012.
